Thus, the Brazilian state has the obligation to protect and promote the mentioned right, also foreseen in other legislations and public policies of Brazil. The National School Feeding Program (PNAE), for example, is an essential tool to concretize the right to adequate feeding for public school students and faced a challenge with the advent of the Covid-19 pandemic and and the suspension of in-person classes. How to ensure feeding to the students? In this research, we seek to answer the following questions: what is the history of the right to adequate food in Brazil and what are the difficulties faced in this right in the context of the Covid-19 pandemic? This way, it will be presented the Evolution of the right to adequate feeding as a fundamental right, concept and legal basis. Then, it will be focused on the cronology of the right to scholar feeding in Brazil and the role of PNAE. Finally, it will be adressed how the public policy of scholar feeding took place during the pandemic. It is concluded that, even with the advances, there are still a huge difference between that the law proposes and what the public policy delivers to its aimed subjects. In this monograph the deductive method will be used. O Direito Humano à Alimentação Adequada significa vida. Trata-se de um dos direitos fundamentais reconhecidos em cortes internacionais e confirmado em variados dispositivos e princípios da Constituição Federal do Brasil. Assim, o Estado brasileiro tem a obrigação de proteger e promover o DHAA, previsto também em diversas leis e políticas públicas vigentes no país. O Programa Nacional de Alimentação Escolar, por exemplo é uma ferramenta essencial na concretização do direito à alimentação adequada para estudantes da rede pública de ensino e enfrentou um desafio com o advento da pandemia de Covid-19 e a suspensão das aulas presencias. Como garantir a alimentação dos alunos? Neste trabalho, procura-se responder aos seguintes questionamentos: Qual o histórico do direito à alimentação adequada no Brasil e quais as dificuldades enfrentadas para esse direito no contexto da pandemia de Covid-19? Dessa forma, apresentar-se-á a evolução do direito à alimentação enquanto direito fundamental, conceito e base legal. Em seguida, focar-se-á na cronologia do direito à alimentação escolar no Brasil e o papel do PNAE. Por fim, será abordado como se deu a política pública de alimentação escolar durante a pandemia. Conclui-se que, mesmo com os avanços, ainda existe uma enorme diferença entre o que a lei propõe e o que a política pública entrega aos sujeitos de direito.
