Resumo: | The Federal Constitution of 1988, when materializing the principle of presumption of innocence, establishes the final and unappealable decision of the sentence as a legal act capable of enforcing the fulfillment of the sentence by the defendant. In parallel, the text from the constitution consolidates the Jury Court as a fundamental right and guarantee, having the sovereignty of verdicts as one of the structuring principles of the institution. Thus, this work aims at evaluating the constitutionality of the immediate compliance of a penalty, before the maximum estoppel of the condemnatory title, in processes under both the Court of Jury and the sovereignty of verdicts. Thus, analyzing any collision or harmony of the constitutional principles already mentioned; examining the relevance of the principle of the double degree of jurisdiction, a rule of a supra legal nature in the matter; discussing the implications of the judgment of the Direct Constitutional Actions No. 43, 44, and 54, and observing whether the changes contained in Law No. 13,964/2019 effectively accommodated the principles under debate, from a descriptive research, within a qualitative approach of case law from the Federal Supreme Court, after the promulgation of the Federal Constitution of 1988, and related legislation and doctrine. |
