Resumo:The Criminal Enforcement Law (CEL)– Law nº 7.210, of 1984 is one of the diplomas that legally regulate the way in which the penalty should be applied in Brazil, aiming at protecting and maintaining the dignity of the human person. Chapter II of the CEL provides for some assistance that the State must provide to prisoners and internees, aiming to prevent crime and guide the return to coexistence in society. The current COVID-19 pandemic scenario requires rapid responses and adjustments from governments in order to continue providing these legal assistance and try to eliminate the contagion and spread of the new coronavirus among the prison population, family members and prison staff. This paper aims to analyze how the assistances provided in the Criminal Enforcement Law is being carried out, even in the context of the current pandemic, having as a case the Dr. Francisco Nogueira Fernandes Penitentiary (Alcaçuz), in Nísia Floresta, RN. In order to carry out the analysis of the theme, a predominantly exploratory research was used, with more flexible research methods, highlighting the deductive logical method, which starts from the theoretical to the practical plan. For this purpose, bibliographical research, literature review, official statistical data collection provided by the Penitentiary, object of analysis, and the collection of information on the topic discussed were used. Finally, given the systemic and historical problems faced by the prison system, especially that of the RN, it was found that the legal assistance provided in the CEL is being provided by the penitentiary, even if partially and limited, in view of the current context of sanitary crisis.
