Therefore, the investigation began by analyzing the historical, social, economic and legal valuation of the Caatinga in its extension, passing through the promulgation of the Constitution and respective hermeneutics, in order to evidence the institutional guarantee bias of the aforementioned device, to finally, to verify the behavior of the procedural instruments for the protection of the institutional guarantee in the face of the absence of forecast of the caatinga in the list mentioned. As for the methodology, it was predominantly used the Descriptive, Exploratory and Evaluative, through bibliographical sources. Finally, it is evident that the protection provided by the constitutional provision dealing with the National Heritage allows, in addition to the institutional guarantee of non-suppression, greater amplitude through procedural instruments, as well as the biome as a whole. O presente trabalho tem por finalidade compreender as consequências jurídico-constitucionais para a Caatinga, a partir da inclusão no rol de biomas considerados como patrimônio nacional, previstos no parágrafo 4º do art. 225 da Constituição Federal, e suas implicações práticas na proteção conferida pela Lei Maior ao referido bioma, na potencialidade de assim ser considerado. Para tanto, a investigação teve início na análise da valorização histórico, social, econômico e jurídica da Caatinga em sua extensão, perpassando à promulgação da Constituição e respectiva hermenêutica, com fim de evidenciar o viés de garantia institucional do aludido dispositivo, para, finalmente, verificar o comportamento dos instrumentos processuais de proteção da garantia institucional, face a ausência de previsão da caatinga no rol em alusão. Quanto à metodologia, utilizou-se predominantemente o método descritivo, exploratório e avaliativo, por intermédio de consulta às fontes bibliográficas.
