Over time, this institute evolves, being incorporated and disciplined into the Brazilian legal system. The Federal Constitution of 1988 established as a fundamental right the right of every child and adolescent to family and community life. Other legal diplomas, such as the Child and Adolescent Statute of 1990 and Law No. 12.010/2009, reinforced this constitutional mandate. However, the adoption of children and adolescents with disabilities - special adoption, only began to gain prominence in 2014, through Law No. 12.955/2014, which began to guarantee priority processing for processes involving children and adolescents with this profile. As well as Law 13.509/2017, which determined the guarantee of preference in registration for individuals interested in adopting a child or adolescent with a disability. Therefore, this work aims to address how special adoption presents itself in Brazil, especially in relation to the State of Rio Grande do Norte – RN. The methodology used is to consult articles, books and legislation relating to the subject. As well as data collected from the CNJ National Adoption and Reception System. It is concluded that the creation of laws encouraging special adoption was an important milestone, as it brought visibility to this type of adoption. Special adoption has been carried out both nationally and regionally, in the case of the state of Rio Grande do Norte, however, the number of adoptions is still small.

A adoção é uma prática antiga compreendida juridicamente como um ato legal, por meio do qual uma pessoa recebe outra pessoa como filho de forma definitiva e com aquisição de vínculo jurídico. Com o passar do tempo, este instituto evolui sendo incorporado e disciplinado no ordenamento jurídico brasileiro. A Constituição Federal de 1988, estabeleceu como direito fundamental, o direito de toda criança e adolescente à convivência familiar e comunitária. Outros diplomas legais como o Estatuto da Criança e do Adolescente de 1990 e a Lei n° 12.010/2009, reforçaram este mandamento constitucional. Contudo, a adoção de crianças e adolescentes com deficiência - adoção especial, só começou a ganhar destaque somente em 2014, através da Lei nº 12.955/2014, que passou a garantir a prioridade de tramitação para processo envolvendo crianças e adolescentes com este perfil. Assim como, a Lei 13.509/2017, que determinou a garantia de preferência no cadastro a indivíduos interessados em adotar uma criança ou adolescente com deficiência. Dessa forma, este trabalho se propõe a abordar como a adoção especial se apresenta no Brasil, em especial com relação ao Estado do Rio Grande do Norte – RN. Utiliza-se como metodologia consultas a artigos, livros e a legislação referente ao assunto. Assim como, dados colhidos do Sistema Nacional de Adoção e Acolhimento do CNJ. Conclui-se que, a criação das leis dando incentivo a adoção especial foi um marco importante, pois trouxe visibilidade para esta espécie de adoção.
