Resumo: | Adoption is an ancient practice legally understood as a legal act, through which a person receives another person as a child definitively and with the acquisition of a legal bond. Over time, this institute evolves, being incorporated and disciplined into the Brazilian legal system. The Federal Constitution of 1988 established as a fundamental right the right of every child and adolescent to family and community life. Other legal diplomas, such as the Child and Adolescent Statute of 1990 and Law No. 12.010/2009, reinforced this constitutional mandate. However, the adoption of children and adolescents with disabilities - special adoption, only began to gain prominence in 2014, through Law No. 12.955/2014, which began to guarantee priority processing for processes involving children and adolescents with this profile. As well as Law 13.509/2017, which determined the guarantee of preference in registration for individuals interested in adopting a child or adolescent with a disability. Therefore, this work aims to address how special adoption presents itself in Brazil, especially in relation to the State of Rio Grande do Norte – RN. The methodology used is to consult articles, books and legislation relating to the subject. As well as data collected from the CNJ National Adoption and Reception System. It is concluded that the creation of laws encouraging special adoption was an important milestone, as it brought visibility to this type of adoption. Special adoption has been carried out both nationally and regionally, in the case of the state of Rio Grande do Norte, however, the number of adoptions is still small. |
