Sobre as contribuições do direito na precarização da vida transvestigênere: o discurso jurídico marginalizante
description This work has, as its main objective, to investigate whether legal discourse contributes to the precariousness of the lives of the transgender population. To do this, it pursues to understand how the law operates as a discourse, verify the way this population is addressed in judicial decisions and unravel the effects of this representation, as well as the possibilities of resistance. The theoretical-epistemological approach starts from a Marxist perspective of law and uses post-structuralism as its central framework, especially the notion of discourse, also seeking to reference transfeminism. It consists of a case study, using a bibliographical review of the topic covered and documentary research on judicial decisions, viewed from a content analysis. A total of 31 decisions from the Court of Justice of Rio Grande do Norte that nominally addressed transidentities were consulted and the following markers were used: (a) which nomenclature was chosen, sorted by thematic scope of the decisions; and (b) wheter the the pronouns and social name of the transgender people approached were respected. As a result, it was observed that the legal discourse contributes to the marginalizing constitution of the transvestigender population, imposing on them embarrassing situations and associating travestis with criminality. Also, it was observed that this process is intrinsically relatede to the greater propensity of this population to suffer lethal violence.

O trabalho tem como objetivo investigar se o discurso jurídico contribui na precarização da vida da população transvestigênere. Para isso, busca entender como o direito opera enquanto discurso, verificar a forma como essa população é abordada em decisões judiciais e destrinchar quais os efeitos dessa representação, assim como quais as possibilidades de resistência. A abordagem teórico-epistemológica parte de uma perspectiva marxista do direito e utiliza como arcabouço central o pós-estruturalismo, em especial a noção de discurso, também buscando referenciar o transfeminismo. Consiste em um estudo de caso, valendo-se de uma revisão bibliográfica do tema abordado e de uma pesquisa documental de decisões judiciais, encaradas a partir de uma análise de conteúdo. Foram consultadas 31 decisões do Tribunal de Justiça do Rio Grande do Norte que abordaram nominalmente transidentidades e foram utilizados os seguintes marcadores: (a) nomenclatura escolhida por recorte temático das decisões; e (b) respeito aos pronomes e nome social das pessoas transvestigêneres abordadas. Como resultados, observou-se que o discurso jurídico colabora com a constituição marginalizante de pessoas transvestigêneres, impondo a elas situações de constrangimento e associando travestis à criminalidade.
