| Resumo: | The economic order in the 1988 Constitution of the Federative Republic of Brazil can be understood as the legal formatting pronounced by the original constituent power to guide the economic production and the national monetary regime, while it presents itself as essential for the study of the theme of legal security in economic terms. In this sense, the issues related to the aspects of the calculability of legal acts as one of the factors of the nation's economic performance are observed, delimiting these two variables in comparison with the autonomy granted to the Central Bank of Brazil through the enactment of Complementary Law No. 179/2021. Thus, the problematic nature of the theme leads to the following question: does the current model of the mentioned institution favor the socio-economic development sculpted in the Constitution of the Federative Republic of Brazil of 1988? The study of the chosen theme is essential because it brings important consequences for the issue of analyzing legal compatibility, notably from the perspective of Constitutional Law, with the State's action in the field of monetary regulation, since this is a variable of great influence on social and economic reality. As methodological procedures, the research line of theoretical type is used, bibliographic technical procedure in conjunction with deductive method. It is concluded that, in the specific case of Brazil, the form of autonomy of the Central Bank seems to favor institutional transparency and foster legal security as one of the factors of socio-economic development woven into the Constitution of the Federative Republic of Brazil of 1988. |
