To elucidate the problem, the essay analyzes the legal nature and characteristics of bitcoins, as well as how these cryptocurrencies can be used in each phase of the crime of money laundering, using the method of dogmatic approach and research of a theoretical-bibliographic nature for the purpose. Among the results of the research, it appears that regulation at the national level is valid, as it aims to bring greater legal certainty to cryptocurrency holders and stipulates minimum criteria for the provision of these services, guaranteeing consumer protection and fraud supervision, however depends on international cooperation to achieve its full effectiveness. No presente trabalho, busca-se analisar se a regulação das criptomoedas pode ser eficaz para a mitigação da utilização de bitcoins como instrumento para cometimento do crime de lavagem de dinheiro, e, sendo possível, observar quais aspectos devem ser considerados em uma atividade regulatória desse instrumento em âmbito nacional. Para elucidar a problemática, o trabalho analisa a natureza jurídica e as características dos bitcoins, bem como essas criptomoedas podem ser empregadas em cada fase do crime de lavagem de dinheiro, valendo-se do método de abordagem dogmática e pesquisa de natureza teórico-bibliográfica para tanto. Dentre os resultados da pesquisa, verifica-se que a regulação em âmbito nacional é válida, pois visa trazer maior segurança jurídica aos possuidores de criptomoedas e estipula critérios mínimos para a prestação desses serviços, garantindo a proteção do consumidor e a fiscalização de fraudes, todavia depende da cooperação internacional para alcançar sua total efetividade. 2023-11-24T13:11:26Z 2023-11-24T13:11:26Z 2023-08-28 bachelorThesis ROSARIO, Mariana Hemilly Pereira.
