This thesis analysed the textual-discursive representations (TDR) of José Dirceu and of
Operation Carwash in its (re)structured redaction in the court ruling elaborated by TRF4
(Fourth Region Federal Tribunal) that denied the habeas corpus requested by Dirceu’s
defence. For that purpose, we based the study on Grize’s theoretical scheme and
argumentative omnipresence and on Textual-Discursive Analysis (TDA), electing a
methodological approach according to Adam (2011, 2017, 2019). The research focused on the
semantic and the argumentative aspects of the court ruling, highlighting schematization,
TDRs and argumentative orientation. To explore the juridic discourse, this work considered
researches such as the ones developed by Lourenço (2015), Nucci (2019), Rodrigues (2016),
amongst others. Methodologically, we adopted the mixed method (deductive and inductive).
Based on the sources used, the research is classified as bibliographical and documental and,
according to its goals, is an investigation of descriptive and explanatory traits, with a
qualitative outlook of the studied material. The research’s corpus is the ruling that resulted
from José Dirceu’s habeas corpus judgement (503454282.2015.4.04.0000/PR), after his
preventive incarceration, decreed by the 13th Federal Court of the Judiciary Subsection in
Curitiba/PR in 3 August of 2015 in the context of the 17th phase of Operation Carwash. Under
the argument of a lacking array of fundaments in the arrestment order, the defence formalized
the habeas corpus to TRF4, occasion in which it was denied. For the analysis of the TDRs,
this study uses specific textualizing operations: referencing, modification of referencing,
predication and modification of predication. The results evidence different RTDs for José
Dirceu that include the juridic sphere (patient, investigated subject, jurisprudential), the
political universe (former Chief of Staff Minister, high ranking politician), the professional
ambit (partner to his brother, consultant to company JD Assessoria e Consultoria LTDA) and
the Operation Carwash investigation (operation of extraordinary dimension, biggest operation,
operation of one of the most promiscuous relations between public and private interests,
biggest corruption case investigated). As a result, it was noted that the lexical selection and
the recategorization (re)construct Dirceu and Operation Carwash’s RTDs. Both linguistic
operations are found discursively in the text, in an individualized manner, and also
collectively in social spheres. The categories investigated can be considered, enunciatively, as
the effects of the argumentative strategies used by the chief judges to orientate
argumentatively that, as José Dirceu was the mentor of a criminal organization, the habeas
corpus requested had to be denied considering the necessity or guaranteeing the public order.
The processes of (re)construction of the RTDs are created within the text’s continuity and
speak of the construction of meanings in the text that derivate from schematization and
omnipresence of argumentation. Furthermore, the linguistic strategies of introduction and of
resuming the referent characterize/qualify the object of speech peculiarly in a process of
anaphoric referencing. In view of the social importance of the forensic text and, especially, of
the impact of the court ruling in the lives of the Brazilian citizens and in academic studies, it
was possible to perceive the relevance of researches that analyse the texts semantically,
focusing the construction of the object of speech’s representations considering the
argumentative orientation. |

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES Analisamos nesta tese as Representações textual-discursivas (Rtd) de José Dirceu e da Operação Lava Jato (OLJ) (re)construídas no acórdão de habeas corpus do TRF4. Para isso, buscamos fundamento nos pressupostos teóricos da esquematização e onipresença da argumentação de Grize e da Análise Textual dos Discursos (ATD), abordagem teóricometodológica proposta por Adam (2011, 2017, 2019). No que concerne a essa abordagem, a pesquisa tem seu foco no nível semântico do texto, com destaque para a noção de esquematização e de Rtd, com Grize (1990, 1996, 1997) e Adam (2011), respectivamente, e no nível argumentativo, com a orientação argumentativa. No âmbito do discurso jurídico, o estudo tem por base pesquisas de vários autores, entre eles, Lourenço (2015), Nucci (2019), Rodrigues (2016) e outros. De modo metodológico, adotamos o método misto (dedutivo e indutivo) e quanto à natureza das fontes utilizadas, classificamos a pesquisa como do tipo bibliográfica e documental, tendo, segundo seus objetivos, a denominação de uma investigação de caráter descritivo e explicativo, com modo qualitativo de abordagem do material estudado. O corpus da pesquisa é o acórdão resultante de julgamento de habeas corpus (503454282.2015.4.04.0000/PR), oriundo da prisão preventiva de José Dirceu, que foi decretada, no contexto da 17ª fase da cognominada “Operação Lava Jato”, em 03.08.2015, pelo Juízo da 13ª Vara Federal da Subseção Judiciária de Curitiba/PR, sob a argumentação de ausência de fundamentação da ordem prisional, a defesa formalizou habeas corpus no contexto do TRF4, ocasião em que a ordem restou denegada. Para a análise dessas Rtd, este estudo utiliza operações de textualização específicas: referenciação, modificação da referenciação, predicação e modificação da predicação. Os resultados apontam diferentes Rtd de José Dirceu nas esferas jurídica (paciente, investigado e jurisprudencial), política (Ex- Ministro da Casa Civil e político de alto escalão) e profissional (sócio do irmão, assessor e consultor e titular da empresa JD Assessoria e Consultoria Ltda) e da OLJ (operação de dimensão extraordinária, maior operação, investigação de um dos mais promíscuos relacionamentos entre o público e privado e maior caso de corrupção investigado). Para isso, a seleção lexical e a recategorização (re)constrem as Rtds de José Dirceu e da OLJ de forma interligadas e se encontram discursivamente no texto de forma individualizada e coletiva nas esferas sociais, podendo ser consideradas, enunciativamente, como o efeito de estratégias argumentativas no acórdão pelos desembargadores para orientar argumentativamente José Dirceu como mentor de uma organização criminosa a fim de denegar o pedido de habeas corpus em virtude da fundamentação na garantia da ordem pública. Os processos de (re)construção dessas Rtds surgem na continuidade textual e dizem respeito aos recursos de construção de sentidos do texto a partir da esquematização e da onipresença da argumentação. Além disso, as estratégias linguísticas de introdução e de retomada do referente caracterizam/qualificam de forma peculiar o objeto de discurso a partir do processo de referenciação anafórico.
