description The urban land regularization of social interest is a process aimed at ensuring the constitutional right to adequate housing and the social function of property in informal urban areas, with the aim of ensuring legal security for holders and promoting the reduction of social inequalities. To implement land regularization, it is essential that there is efficient urban governance and appropriate urban planning. This includes the participation of residents in the regularization process, the definition of clear and objective criteria for regularization, and the creation of monitoring and control mechanisms to ensure the effectiveness of the process. Indeed, the problem of the theme revolves around the following question: how can urban land regularization of social interest be an instrument of protection to the fundamental right to housing? Given the existence of irregular occupations and housing deficits in urban areas, the need arises to investigate how land regularization of social interest can face these issues and ensure access to adequate housing for the most vulnerable population. The study of the chosen theme is important given that decent housing is a fundamental right recognized internationally, and urban land regularization presents itself as an essential tool to realize this right. Therefore, understanding its role and its potentials is essential for the formulation and implementation of effective public policies in the housing area. Among the difficulties pointed out, the objective is to analyze urban land regularization of social interest as an instrument of protection to the fundamental right to housing, identifying its legal, social, and urbanistic implications, as well as its impacts on improving the living conditions of the benefited population. The research will be carried out through a qualitative approach, based on bibliographic and documentary research to support the study. Official data and information on programs and experiences of urban land regularization of social interest will be used, in addition to the analysis of legislations and case studies to complement the understanding of the theme. It is concluded that urban land regularization of social interest, combined with urban governance and urban planning, are fundamental strategies for the sustainable development of cities, allowing for the organization of urban space, access to property, and decent housing.

A regularização fundiária urbana de interesse social é um processo que visa garantir o direito constitucional à moradia adequada e à função social da propriedade em áreas urbanas informais, no intuito de garantir a segurança jurídica dos possuidores e de promover a redução das desigualdades sociais. Para implementar a regularização fundiária, é fundamental que haja uma governança urbana eficiente e um planejamento urbano adequado. Isso inclui a participação dos moradores no processo de regularização, a definição de critérios claros e objetivos para a regularização e a criação de mecanismos de fiscalização e de controle para garantir a efetividade do processo. Com efeito, evidencia-se que a problemática do tema está em torno do seguinte questionamento: como a regularização fundiária urbana de interesse social pode ser um instrumento de proteção ao direito fundamental à moradia? Diante da existência de ocupações irregulares e de déficits habitacionais nas áreas urbanas, surge a necessidade de investigar como a regularização fundiária de interesse social pode enfrentar essas questões e assegurar o acesso à moradia adequada para a população mais vulnerável. O estudo do tema escolhido é importante haja vista que a moradia digna é um direito fundamental reconhecido internacionalmente, e a regularização fundiária urbana se apresenta como uma ferramenta essencial para concretizar esse direito. Portanto, compreender seu papel e as suas potencialidades é fundamental para a formulação e para a implementação de políticas públicas eficazes na área habitacional. Dentre as dificuldades apontadas, objetiva-se analisar a regularização fundiária urbana de interesse social como instrumento de proteção ao direito fundamental à moradia, identificando suas implicações jurídicas, sociais e urbanísticas, bem como seus impactos na melhoria das condições de vida da população beneficiada. A pesquisa será realizada por meio de uma abordagem qualitativa, com base em pesquisa bibliográfica e documental para fundamentar o estudo. Serão utilizados dados e informações oficiais sobre programas e experiências de regularização fundiária urbana de interesse social, além de análise de legislações e estudos de caso para complementar a compreensão do tema.
