The present study delves into the collective protection of individual rights as an instrument for
access to justice for workers. It is argued that the massification of societal demands and the
resulting multiplication of repetitive judicial proceedings submitted to the Judiciary have led to
a hindrance in the judicial machinery, with consequences for the reasonable duration of the
process and legal certainty. In addition to this, within the scope of labor relations, the imbalance
between the parties to the substantive legal relationship (employer and employee), the fear of
retaliation for resorting to the Judiciary, and the reforms introduced by Law No. 13,467/2017
(Labor Reform) constitute true deterrents to individual access to the Judiciary by employees for
the protection of their rights. Thus, the collective protection of labor rights, through legitimate
collective entities, constitutes a means of effective, appropriate, and timely access to justice for
workers. However, in order for the collective protection of individual rights to ensure all
constitutional procedural rights inherent in the due process of law, thus enabling access to
justice from a substantive perspective, it is necessary for the claimed rights to be effectively
capable of collective safeguarding. Consequently, the following research problem is submitted
to the present study: is the legal concept of homogeneous individual rights sufficient to allow
for their collective protection? In the event of a negative answer, what are the necessary
prerequisites for the characterization of individually protectable rights in a collective manner?
As a hypothesis, it is argued that the legal concept of homogeneous individual rights, defined
as those arising from a "common origin," is incomplete and insufficient for their effective
collective protection. In addition to a "common origin," the predominance of common issues
over individual issues is necessary to ensure an appropriate collective process for the protection
of these interests. The research has a deductive character, employing quantitative and
qualitative methods, and employs the analysis of the case that motivated this study as a substrate
for the problem to be investigated. The case study serves as an instrumental element for the
research, supplemented by a literature review with a focus on constitutional procedural law, as
well as exploratory research in legal doctrine and jurisprudence. Based on the research path
followed, the conclusion reached confirms the previously raised hypothesis that the legal
concept of homogeneous individual rights is insufficient for the characterization of these rights
to allow for their collective protection. Therefore, the predominance of common issues over
individual issues is an indispensable attribute for their characterization. |

O presente estudo se debruça sobre a tutela coletiva de direitos individuais como um instrumento de acesso à justiça aos trabalhadores. Tem-se que a massificação das demandas da sociedade e consequente multiplicação dos processos judiciais repetitivos submetidos ao Poder Judiciário implicam em uma obstrução da máquina judicial, com consequências na razoável duração do processo e na segurança jurídica. Somado a isso, no âmbito das relações laborais, o desequilíbrio havido entre as partes da relação de direito material (empregador e empregado), o medo de retaliação de recorrer ao Judiciário e as reformas advindas da Lei n.º 13.467/2017 (Reforma Trabalhista) constituem verdadeiros desestímulos à busca individual do Poder Judiciário, pelos empregados, para a proteção aos seus direitos. Por isso, a proteção coletiva dos direitos laborais, a partir de entes legitimados coletivos, constitui meio de acesso à justiça efetiva, adequada e tempestiva aos trabalhadores. Todavia, para que a proteção coletiva de direitos individuais assegure todos os direitos processuais constitucionais inerentes ao devido processo legal, viabilizando o acesso à justiça em sua perspectiva substancial, é necessário que os direitos postulados sejam, de fato, tuteláveis coletivamente. Por isso, submete-se ao presente estudo o seguinte problema de pesquisa: o conceito legal de direitos individuais homogêneos é suficiente para se admitir a sua tutela coletiva? Em caso negativo, quais os pressupostos necessários à caracterização dos direitos individuais tuteláveis coletivamente? Tem-se, a título de hipótese, que o conceito legal de direitos individuais homogêneos, como aqueles decorrentes de uma “origem comum” é lacunoso e insuficiente à sua efetiva proteção coletiva, sendo necessária, além da “origem comum”, a predominância de questões comuns sobre questões individuais, para que seja assegurado um processo coletivo adequado à tutela desses interesses. A pesquisa tem caráter dedutivo, com a utilização de métodos quanti-qualitativos, e utiliza a análise do caso que motivou o presente estudo como substrato para o problema a ser investigado. O estudo de caso tem caráter instrumental para a pesquisa e a ele se soma a revisão bibliográfica, com enforque no direito processual constitucional, e a pesquisa exploratória na doutrina e jurisprudência.
