The theme is necessary to enable the affirmation and binding of the fundamental rights inherent to people with unilateral deafness, inserting them in the labor market, a fact that goes back to principled aspects of the Democratic State of Law, such as the dignity of the human person and the isonomy. It aims to demonstrate that the unilateral hearing impaired must have equal opportunity to access the labor market, putting into effect the principle of full employment, equivalent to other people with disabilities. As a methodology, a bibliographic review was carried out in the light of the Federal Constitution, complementary laws and jurisprudence applied in higher courts. The Law, as the proper object of justice, which obliges everyone to give what is due to them, needs to protect and guarantee equality, justice and freedom, assuring unilateral deaf people the enjoyment of the right to difference in the equality of rights. There is no half disability. The unilateral deaf person is a person with a disability. Only with the consolidation of the isonomic condition of unilateral deaf people, as a person with a disability, will equality, personal independence, dignity, non-discrimination and full and effective participation and social inclusion be guaranteed, especially in the labor market. O presente estudo busca analisar situações encontradas no sistema judiciário brasileiro que envolvem direitos sociais das pessoas com deficiência auditiva unilateral. A temática faz-se necessária ao possibilitar a afirmação e vinculação dos direitos fundamentais inerentes às pessoas de surdez unilateral, inserindo-os no mercado de trabalho, fato este que remonta a aspectos principiológicos do Estado Democrático de Direito, como a dignidade da pessoa humana e a isonomia. Possui como objetivo demonstrar que o deficiente auditivo unilateral deve ter igual oportunidade de acesso ao mercado do trabalho, efetivando o princípio do pleno emprego, equivalendo-se às demais pessoas com deficiência. Como metodologia, foi realizada uma revisão bibliográfica à luz da Constituição Federal, leis complementares e jurisprudências aplicadas em tribunais superiores. O Direito, por ser o objeto próprio da justiça, que obriga a dar a cada um o que lhe é devido, precisa proteger e garantir a igualdade, a justiça e a liberdade, asseverando aos surdos unilaterais o gozo do direito à diferença na igualdade dos direitos. Não existe meia deficiência. O surdo unilateral é deficiente por completo.
