description In Brazil, the homeless population grows significantly, especially if the post-pandemic scenario is taken into account. However, based on the invisibility conferred on the group, the performance of some institutions ends up being the only way found by such individuals to gain access to their constitutional rights. In this context, the Public Defender's Office emerges as a judicial function of the State, which is responsible for legal guidance, the promotion of fundamental rights and the defense of the individual and collective rights of the vulnerable. In this sense, homeless people are part of the institution's target audience, being considered hypervulnerable, given that they do not have their existential minimum assured. With this, the present study starts from the following problem: how does the Public Defender’s work provide homeless people with access to justice and, consequently, to their fundamental rights? It works, then, with the hypothesis that the institution guarantees access to fundamental rights to the mentioned population group through judicial and extrajudicial means, but that there is still a need for this exercise to grow in order to reach the population portion under discussion in its entirety. From this, an analysis was carried out of how the performance of the Nucleus for the Defense of Vulnerable Social Groups and the Homeless Population (NUDEV), a specialized nucleus of the Public Defender’s Office of the State of Rio Grande do Norte, enables access to justice by the homeless people in Natal/RN. Thereby, this research seeks to examine the role of the Public Defender's Office as an institution responsible for meeting the demands of the aforementioned population group. This objective is achieved through a qualitative and exploratory approach, since it uses the analysis of bibliographic and documentary sources, in addition to the study of the actions carried out by the core member of the DPE/RN. The analysis of the results obtained leads to an understanding that the Public Defender's Office promotes the guarantee of fundamental rights and access to justice for the homeless population through different means, such as issuing recommendations to the Public Power; filing lawsuits to protect the group's diffuse and collective rights; and the use of the active search strategy to understand the demands of this segment. However, it is possible to conclude that such tools are still not enough to overcome the various obstacles that prevent complete access to justice by that group.

No Brasil, a população em situação de rua cresce significativamente, sobretudo se levado em consideração o cenário pós pandemia. Entretanto, a partir da invisibilidade conferida ao grupo, a atuação de algumas instituições acaba sendo a única forma encontrada por tais indivíduos para ter acesso a seus direitos previstos constitucionalmente. Diante desse contexto, surge a Defensoria Pública enquanto função jurisdicional do Estado, à qual incumbe a orientação jurídica, a promoção dos direitos fundamentais e a defesa dos direitos individuais e coletivos dos vulneráveis. Nesse sentido, as pessoas em situação de rua são parte do público-alvo da instituição, sendo consideradas hipervulneráveis, tendo em vista que não têm o seu mínimo existencial assegurado. Com isso, o presente estudo parte do seguinte problema: como a atuação da Defensoria Pública proporciona às pessoas em situação de rua o acesso à justiça e, consequentemente, aos seus direitos fundamentais? Trabalha-se, então, com a hipótese de que a instituição garante o acesso aos direitos fundamentais pelo referido grupo populacional através de meios judiciais e extrajudiciais, mas que ainda há a necessidade de um crescimento desse exercício para conseguir atingir a parcela populacional em comento em sua totalidade. A partir disso, foi realizada uma análise de como a atuação do Núcleo de Defesa dos Grupos Sociais Vulneráveis e da População em Situação de Rua (NUDEV), núcleo especializado da Defensoria Pública do Estado do Rio Grande do Norte, possibilita o acesso à justiça pelas pessoas em situação de rua de Natal/RN. Desse modo, esta pesquisa busca examinar o papel da Defensoria Pública enquanto instituição responsável por atender as demandas do referido grupo populacional. Tal objetivo é alcançado através de uma abordagem qualitativa e exploratória, uma vez que se utiliza da análise de fontes bibliográficas e documentais, além do estudo das ações realizadas pelo núcleo integrante da DPE/RN. A análise dos resultados obtidos produz uma compreensão de que a Defensoria Pública promove a garantia dos direitos fundamentais e o acesso à justiça de população em situação de rua através de distintos meios, como a expedição de notas recomendativas ao Poder Público; o ajuizamento de ações para tutela dos direitos difusos e coletivos do grupo; e a utilização da estratégia de busca ativa para compreender as demandas dessa parcela.
