In addition to the legal and academic discussion, the aforementioned topic produced, and still does, important political debate in various social spheres. The supreme court has changed its orientation a few times and with a lot of internal divergence (allowing in some moments, and denying in others, the possibility of the anticipated execution of the sentence imposed before its transit in rem judicatam). The objective of this study is precisely to discover the reasons that led the Federal Supreme Court to change its understanding several times, and thus become the source to judge whether the planned execution penalty is constitutional. The analysis of the judgments is essential to understand the points of divergence and the norms involved in this important discussion. In addition, based on the analysis of the judgments, it is possible to understand, historically, how the Federal Supreme Court arrived at the current understanding on the subject and, therefore, how it was constructed, dialectically, over the years within the supreme court. Um dos temas mais controversos, nos últimos anos, no âmbito do Supremo Tribunal Federal, foi a execução antecipada da pena. Além da discussão jurídica e acadêmica, o referido tema produziu, e ainda produz, importante debate político em diversas esferas sociais. A suprema corte mudou sua orientação, algumas vezes, e com bastante divergência interna (permitindo em alguns momentos, e negando em outros, a possibilidade da execução antecipada da pena imposta antes do seu trânsito em julgado). O objetivo desta pesquisa foi justamente descobrir os fundamentos que levaram o Supremo Tribunal Federal a mudar tantas vezes o seu entendimento, tendo, por consequência disso, a finalidade de descobrir se a execução antecipada da pena é constitucional. A análise dos julgados é fundamental para que se possa entender os pontos de divergência e as normas envolvidas nessa importante discussão.
