The idea of the right to the city as a human right, in turn, was debated worldwide at the
end of the 20th century, with the presentation of the World Charter for the Right to the
City at the World Social Forum (2006), which highlighted the need to protect the rights
of the man in the urban environment. The main objective of this research is to analyze
the right to the city of people with disabilities and the Urban Mobility Plan in the city of
João Pessoa - PB, and specifically to situate the historical evolution of the rights of
people with disabilities in Brazil; situate the public policies that contribute to the
maintenance of people with disabilities in society and finally analyze the urban mobility
plan of João Pessoa - PB. When approaching the theme of the city, it is necessary to
understand that the object of study is inserted in a completely multidimensional field
that involves several legal, social and political interfaces. To substantiate the state of
the art, we will use the main notions and theories about the city discussed by Henri
Lefebvre and David Harvey and the contributions of Ermínia Maricato, Marcelo Lopes
de Sousa, Amartyan Sen, Manuel Castells, and other authors who address issues
related to democracy, development and public policies. The methodology used is
documental, considering the official documents of the municipality and other special
legislation that address the subject. Bibliographical research is also present given the
vast literary collection on the right to the city, accessibility, inclusion and urban mobility.
It appears that in Brazil, with the advent of Federal Law 10,587 of 2012, which instituted
the National Urban Mobility Policy, it was possible to create mechanisms and
guidelines for urban mobility, highlighting the development of the social functions of
the city and its inhabitants. As well as that when a city establishes an urban mobility
policy that aims to promote the right of all citizens as a form of human and social
development of its citizens, it reduces the obstacles that prevent the individual from
enjoying the public space and contributes to the incorporation of the Citizenship
functions (Education, Health, Protection and Security) and Management Functions
(Provision of Services, Planning, Preservation of Cultural and Natural Heritage and
Urban Sustainability). |

A ideia de direito à cidade como direito humano, por sua vez, foi mundialmente debatido, no final do século XX, com a apresentação da Carta Mundial pelo Direito à Cidade do Fórum Social Mundial em 2006 que avultou a necessidade de tutelar os direitos do homem no âmbito urbano. Esta pesquisa tem como objetivo principal analisar o direito à cidade das pessoas com deficiência e o Plano de mobilidade urbana do município de João Pessoa – PB e de forma específica situar a evolução histórica dos direitos das pessoas com deficiência no Brasil; situar as políticas públicas que contribuem para a manutenção das pessoas com deficiência na sociedade e por último analisar o plano de mobilidade urbana de João Pessoa – PB. Ao abordar a temática da cidade se faz necessário compreender que o objeto de estudo está inserido em um campo completamente multidimensional que envolve diversas interfaces jurídicas, sociais e políticas. Para substanciar o estado da arte utilizaremos as principais noções e teorias sobre a cidade discutidas por Henri Lefebvre e David Harvey e as contribuições de Ermínia Maricato, Marcelo Lopes de Sousa, Amartyan Sen, Manuel Castells, e outros autores que abordam questões ligadas a democracia, desenvolvimento e políticas públicas. A metodologia utilizada é a documental, tendo em vista os documentos oficiais do município e outras legislações especiais que abordam o tema. A pesquisa bibliográfica também se faz presente visto o vasto acervo literário sobre direito à cidade, acessibilidade, inclusão e mobilidade urbana. Constatase que no Brasil, com o advento da Lei Federal 10.587 de 2012 que instituiu A política Nacional de Mobilidade Urbana, foi possível criar mecanismo e diretrizes para a mobilidade urbana, evidenciando o desenvolvimento das funções sociais da cidade e de seus habitantes.
