description The purpose of this monograph is to study the possibility of applying Restorative Justice in cases of Domestic and Family Violence Against Women. To this end, the study will analyze “Lei nº 11.340/06”, the current legal diploma responsible for the treatment of the above-mentioned cases, in order to verify possible flaws originating from its practice. In this regard, the results of 4 (four) surveys will be used, obtained through interviews with victims, offenders and magistrates involved in cases in the Courts for Domestic and Family Violence against Women throughout Brazil. Then, it will continue by studying Restorative Justice, especially its principles and values, as well as a brief overview of its development in the country. After collecting such elements, it will finally verify if the restorative ideals are compatible with the offenses committed in domestic and familiar violence against women, as well as if the model has potential to attend the women's expectations and find effective solutions, beyond the punishment of the offenders. That said, the results obtained show dissatisfaction of most women who appeal to traditional criminal justice and point to the need to go beyond the application of the custodial penalty as the only way to solve the cases. It was also concluded that restorative practices present potentials and risks when applied to these cases and, for this reason, it should be done with caution. In Brazil, due to the short time of maturation and experience with Restorative Justice, it was concluded about the importance of the continuation of ongoing projects, in concomitance with the permanent dialogue and engagement of the scientific community in researches on the subject, in order to allow the collection of more data on the applicability of the model.

A presente monografia propõe-se a estudar a possibilidade de aplicação da Justiça Restaurativa em casos de Violência Doméstica e Familiar Contra a Mulher (VDFCM). Para tanto, o trabalho se debruça sobre o estudo da Lei 11.340/06, diploma legal em vigor responsável pelo tratamento dos casos supramencionados, a fim de verificar possíveis falhas oriundas de sua prática. Nesse sentido, recorrer-se-á aos resultados alcançados em 4 (quatro) pesquisas, obtidos por meio de entrevistas com vítimas, ofensores e magistrados envolvidos em casos de Juizados de Violência Doméstica e Familiar contra a Mulher (JVDFCM) pelo Brasil. Em seguida, dará continuidade por meio do estudo da Justiça Restaurativa, em especial de seus princípios e valores, assim como fará um breve apanhado de seu desenvolvimento no país. Após coletados tais elementos, irá, enfim, verificar se os ideais restaurativos são compatíveis com os delitos cometidos em sede de violência doméstica e familiar contra a mulher, bem como se o modelo possui potencial para atender as expectativas das mulheres e encontrar soluções eficazes, para além da punição dos ofensores. Dito isso, os resultados obtidos demonstram insatisfação por grande parte das mulheres que recorrem à tradicional justiça criminal e apontam para a necessidade de se ir além da aplicação da pena privativa de liberdade como via única para resolução dos casos de VDFCM. Concluiu-se, também, que as práticas restaurativas apresentam potencialidades e riscos quando aplicadas a esses casos e, por tal motivo, deve-se aplicá-las com cautela. Paralelamente, a perspectiva de gênero e reconhecimento das desigualdades existentes na relação devem sempre nortear as práticas.
