Resumo:The purpose of this monograph is to study the possibility of applying Restorative Justice in cases of Domestic and Family Violence Against Women. To this end, the study will analyze “Lei nº 11.340/06”, the current legal diploma responsible for the treatment of the above-mentioned cases, in order to verify possible flaws originating from its practice. In this regard, the results of 4 (four) surveys will be used, obtained through interviews with victims, offenders and magistrates involved in cases in the Courts for Domestic and Family Violence against Women throughout Brazil. Then, it will continue by studying Restorative Justice, especially its principles and values, as well as a brief overview of its development in the country. After collecting such elements, it will finally verify if the restorative ideals are compatible with the offenses committed in domestic and familiar violence against women, as well as if the model has potential to attend the women's expectations and find effective solutions, beyond the punishment of the offenders. That said, the results obtained show dissatisfaction of most women who appeal to traditional criminal justice and point to the need to go beyond the application of the custodial penalty as the only way to solve the cases. It was also concluded that restorative practices present potentials and risks when applied to these cases and, for this reason, it should be done with caution. In Brazil, due to the short time of maturation and experience with Restorative Justice, it was concluded about the importance of the continuation of ongoing projects, in concomitance with the permanent dialogue and engagement of the scientific community in researches on the subject, in order to allow the collection of more data on the applicability of the model.
