| Resumo: | The poor performance of public health actions and services is a reality in hospitals and basic health units in Brazil, a fact that contributes to a significant number of actions aimed at realizing the right to health of those who denied it. In this sense, the present work deals with the judicialization of health, its negative aspects regarding the management of the budget and the public policies and the self - consumption methods as an alternative to that one. The method used for this was the bibliographic review in books, articles and websites specialized in the subject in question and it is aimed, with such research, to analyze how damaging the judicialization can be in an excessive way, so that, in order to guarantee the of fundamental rights, it ends up disorganizing the budget to the point of harming the very execution of public policies aimed at collectivity. In addition, the present work proposes that alternative methods of solving alternative conflicts and / or allied with the judicialization be finalized with the example of the SUS program, mediated by the public defenders of Rio Grande do Norte. |
