On the other hand, it is also true that from its use came a series of problems, among which it is possible to mention the modernization and the incremento of the complexity of criminal techniques, a phenomenon that culminated in the development of computer crimes. The present work aims to identify what are the main challenges presented to Brazilian Criminal Law regarding these crimes, proposing possible ways to face them. The research was basic strategic, descriptive, with qualitative approach, hypothetical-deductive method and bibliographic technique, based on legislation, doctrine and precedents. Finally, three major challenges are highlighted, related to the investigation of cybercrimes, their transnationality and the mechanisms of information security. In addition, some measures that can be taken by the Brazilian State and by the individuals are pointed out, in order to improve this battle. É certo que a internet proporcionou um considerável aumento do fluxo de informações entre os mais diversos membros da sociedade, sejam indivíduos, organizações ou mesmo Estados, trazendo incontáveis benefícios para a humanidade e oferecendo as mais variadas facilidades para a vida cotidiana, tanto no que se refere à produção econômica quanto à comunicação de forma geral. Por outro lado, é bem verdade que do seu uso adveio uma série de problemas, dentre os quais é possível citar a modernização e o aumento da complexidade das técnicas delitivas, fenômeno este que culminou no desenvolvimento dos denominados crimes informáticos. O presente trabalho tem por objetivo identificar quais são os principais desafios apresentados ao Direito Penal brasileiro no que diz respeito a esses crimes, propondo possíveis meios para enfrenta-los. Para tanto, foi realizada uma pesquisa básica estratégica, descritiva, de abordagem qualitativa, método hipotético-dedutivo e técnica bibliográfica, com apoio na legislação, na doutrina e na jurisprudência. Ao final, são destacados três grandes desafios, relacionados à investigação dos delitos cibernéticos, à sua transnacionalidade e aos mecanismos de segurança da informação.
