description This final paper aims to study the homeless population, notably in Brazil and the city of Natal, also under the focus of some regulations regarding the public policies to this population, flowing into the analysis of the performance of the Public Defender’s Office in face of the reality experienced by that population. In order to do so, it is studied the general panorama of the phenomenon of the homeless population, as well as their recent history, with the analysis of data on existing research, especially when it comes to the local (Natal / RN) and National contexts. At the same time, there are violations of rights suffered by the population living on the streets and, in this regard, there is a lack of official data that reflects the reality of this minority in these contexts, making it difficult to elaborate policies that do not exist yet or to implement the existing ones. Subsequently, the public policies were conceptualized, as well as, thereafter, the main norms that regulate such policies directed at street people. Thus, considering the need to analyze the local reality under a closer perspective, and knowing that the Municipal Policy for this population does not exist, a special focus will also be given to the State Policy (RN) for the homeless population, in force since the year 2018. Lastly, due to the importance of a concretion of the homeless people’s rights, especially with the reality of violation of those rights, an analysis of the Public Defender's work was carried out, with the following guiding points: the need to provide access to justice from the perspective of those who survive on the street, given their peculiarities, a need which is granted as well by documents approved within the Public Defender's Office, in accordance with the guidelines of those specific public policies, with the proposal of joint action between the State Public Defender's Office and the National Public Defender's Office; the analysis of the National Public Defender’s Office’s operation when it comes to legal aid in relation to assistance benefits, focusing on the Benefit of Continuous Provision, as well as the Office’s legal action in the scope of collective tutelage, notably with emphasis on the Public Civil Action; and the critique regarding the precariousness experienced by the Public Defender's Office.

O presente trabalho de conclusão de curso tem por finalidade estudar a população em situação de rua, notadamente no âmbito do Brasil e da cidade de Natal, também sob o enfoque de algumas normativas que regulam as políticas públicas a essa população, desaguando na análise da atuação da Defensoria Pública frente à realidade vivenciada por aquela população, notadamente quanto à necessidade de concretização de direitos, tendo em vista que se encontram em notório contexto de vulnerabilidade. Para tanto, estuda-se o panorama geral do fenômeno da população em situação de rua, bem como a sua história recente, com a análise de dados sobre pesquisas existentes, especialmente tratando-se dos contextos local (Natal/RN) e Nacional. Verifica-se, concomitantemente, as violações de direitos sofridas pela população em situação de rua, e, nesse aspecto, também, a inexistência de dados oficiais que espelhem a realidade dessa minoria nos referidos contextos, dificultando-se sobremaneira a elaboração de políticas inexistentes ou a execução das já existentes. Em um segundo momento, cuidou-se de conceituar as políticas públicas, bem como, posteriormente, tratar das principais normativas que regulam tais políticas voltadas às pessoas em situação de rua. Assim, tendo em vista a necessidade de tratar sob um viés mais próximo à realidade local e sabendo-se que inexiste a Política Municipal para essa população, também se dará um enfoque especial à Política Estadual (RN) para a população em situação de rua, em vigor desde o ano de 2018. Por fim, tendo papel fundamental para a concretização dos direitos das pessoas em situação de rua, sobretudo com a realidade posta de violação desses, realizou-se uma análise da atuação da Defensoria Pública frente a esse contexto, com os seguintes pontos norteadores: a necessidade de concretização do acesso à justiça sob a perspectiva das pessoas que (sobre)vivem em situação de rua, visto as peculiaridades características dessas, inclusive constante em documentos aprovados no âmbito interno da Defensoria Pública, em consonância com as diretrizes daquelas políticas públicas específicas, com a propositura de atuação conjunta entre as Defensoria Pública Estadual e Defensoria Pública da União; análise da atuação da Defensoria Pública da União no que tange à assistência jurídica em relação aos benefícios assistências, com enfoque sobre o Benefício de Prestação Continuada, assim como a sua atuação jurídica no âmbito da tutela coletiva, notadamente com ênfase à Ação Civil Pública; por último, houve a crítica quanto à precariedade vivenciada na atuação da Defensoria Pública. 2023-01-09T19:56:37Z 2023-03-07T15:41:58Z 2023-01-09T19:56:37Z 2023-03-07T15:41:58Z 2019-06-28 bachelorThesis 2013092630 SENA, Talita Silva de.
