Resumo:This final paper aims to study the homeless population, notably in Brazil and the city of Natal, also under the focus of some regulations regarding the public policies to this population, flowing into the analysis of the performance of the Public Defender’s Office in face of the reality experienced by that population. In order to do so, it is studied the general panorama of the phenomenon of the homeless population, as well as their recent history, with the analysis of data on existing research, especially when it comes to the local (Natal / RN) and National contexts. At the same time, there are violations of rights suffered by the population living on the streets and, in this regard, there is a lack of official data that reflects the reality of this minority in these contexts, making it difficult to elaborate policies that do not exist yet or to implement the existing ones. Subsequently, the public policies were conceptualized, as well as, thereafter, the main norms that regulate such policies directed at street people. Thus, considering the need to analyze the local reality under a closer perspective, and knowing that the Municipal Policy for this population does not exist, a special focus will also be given to the State Policy (RN) for the homeless population, in force since the year 2018. Lastly, due to the importance of a concretion of the homeless people’s rights, especially with the reality of violation of those rights, an analysis of the Public Defender's work was carried out, with the following guiding points: the need to provide access to justice from the perspective of those who survive on the street, given their peculiarities, a need which is granted as well by documents approved within the Public Defender's Office, in accordance with the guidelines of those specific public policies, with the proposal of joint action between the State Public Defender's Office and the National Public Defender's Office; the analysis of the National Public Defender’s Office’s operation when it comes to legal aid in relation to assistance benefits, focusing on the Benefit of Continuous Provision, as well as the Office’s legal action in the scope of collective tutelage, notably with emphasis on the Public Civil Action; and the critique regarding the precariousness experienced by the Public Defender's Office.
