Thus, it is necessary to investigate how it will be possible to receive it under the existing national legislation, with an emphasis on the Civil Code. Thereat, this work proposes to analyze the obstacles to the effectiveness of the post mortem transmission of profiles on social networks, using exploratory research with bibliographic and documentary basis in the current national and foreign legislation, bills being processed on the subject, cases judged by Brazilian courts, civilist doctrine and the terms of use of social media platforms. Thus, through the deductive method and qualitative approach, based on the assumption of social networks as digital goods, and the participation of the goods of the subject of succession, it appears that there are already means capable of meeting this new social demand. Finally, it is seen the importance that the National Data Protection Authority will play in the definition of good practices and how the Brazilian internet users’ awareness on the subject will contribute to its fulfillment. A falta de regulamentação da herança digital no Brasil tem reflexo na sucessão de perfis em redes sociais, plataformas que agregam à comunicação entre usuários através da internet o acúmulo de bens digitais, de cunho afetivo ou econômico. Dessa forma, faz-se necessário investigar como será possível a sua recepção pela legislação pátria já existente, com ênfase no Código Civil. Com isso, esse trabalho se propôs a analisar os entraves à efetivação da transmissão post mortem de perfis em redes sociais, fazendo uso de pesquisa exploratória com base bibliográfica e documental na legislação vigente, nacional e estrangeira, projetos de lei tramitando sobre o tema, julgados dos tribunais brasileiros, doutrina civilista e os próprios termos de uso das plataformas de redes sociais. Assim, por meio do método dedutivo e abordagem qualitativa, partindo do pressuposto das redes sociais enquanto bens digitais, e da participação dos bens do de cujus rito sucessório, depreende-se que já existem meios capazes de atender à essa nova demanda social.
