Resumo:The lack of regulation of digital heritage in Brazil is reflected in the succession of profiles on social networks, platforms that add to the communication between users through the internet the accumulation of digital goods, of an affective or economic nature. Thus, it is necessary to investigate how it will be possible to receive it under the existing national legislation, with an emphasis on the Civil Code. Thereat, this work proposes to analyze the obstacles to the effectiveness of the post mortem transmission of profiles on social networks, using exploratory research with bibliographic and documentary basis in the current national and foreign legislation, bills being processed on the subject, cases judged by Brazilian courts, civilist doctrine and the terms of use of social media platforms. Thus, through the deductive method and qualitative approach, based on the assumption of social networks as digital goods, and the participation of the goods of the subject of succession, it appears that there are already means capable of meeting this new social demand. Finally, it is seen the importance that the National Data Protection Authority will play in the definition of good practices and how the Brazilian internet users’ awareness on the subject will contribute to its fulfillment.
