Resumo:Mainly concerned about democracy and disrespect for fundamental rights, this research is about fake news and it investigates whether dissemination of information with the clear intention of misrepresenting it violates the constitutional right to be informed. To reach a conclusion, there was an investigation into the concept of fake news, their dissemination in the media, with an emphasis on the internet, and observations were made on freedom of speech. About this, it was pointed out that, despite being a wide freedom, it is not an absolute right, therefore, there are limits and one of those limits may be the right to information. In addition, it was identified that the right to information is not only about the freedom to inform, but also covers the right to find out and the right to be informed. The right to information is also a diffuse right, it has several functions and must be fully observed. The methodology used was the bibliographic one, having as research technique, besides the explored authors, the analysis of jurisprudence and journalistic texts. It was concluded that the intentionally lying information is not covered by the brazilian legal system and that there is a constitutional violation, although there is knowledge of the complexity surrounding the guarantees of the law.
