Resumo:This work aims to analyze the limits provided for in art 12 of Law 9.279 from 1996 (Industrial Property Law), with respect to the exclusive use of a trademark, based on the analysis of the dispute between the companies Apple and Gradiente over the right to use the terminology "iphone". The research developed was made exploratory, of a qualitative nature and there is the study of a real case to clarify the concepts highlighted. Initially, there is a historical introduction to the agreements and legislation regarding industrial property. Then, the concepts, requirements and trademark registration process are addressed. Finally, the case that culminated in the judgment of Superior Court of Justice Appeal No. 1,688,243 - RJ will be analyzed, in order to demonstrate what are the limits imposed by art. 129 of Law 9.279 / 1996.
