Resumo:Currently, the Bolivarian Republic of Venezuela is immersed in a serious political, economic, and social crisis. lthough the roots of this crisis date back to end of the regime of former President Hugo Chávez, it gained a new dimension in 2015, when tensions between the government and the opposition intensified due to the victory of the latter in parliamentary elections. Since then, several Venezuelans have migrated to other countries in order to guarantee their own survival. As Brazil is one of the countries that have been greatly affected by this influx, this dissertation sets out to answer the following question: has the Brazilian state protected the human rights of those migrants in an effective way? The a priori hypothesis from which we depart is that, in spite of having implemented a few measures on behalf of those people, Brazilian authorities still have not been able to fully protect their rights. Hence, this dissertation shall examine the way such state has operated in this context, with the aim of ascertaining the accuracy of the aforementioned hypothesis. In order to do so, it is necessary to accomplish the following goals: explaining the origins and the present dimension of the Venezuelan diaspora; analyzing the national and international legal instruments that can be applied to this situation; investigating the main aspects of the Brazilian migration policy targeted at those migrants; and scrutinizing the way Brazilian courts have operated in the cases involving the concretization of the rights of those individuals. Through this research, it was possible to identify several cases in which the human rights of those migrants were violated by state agents, notably the ones related to the Executive Branch. It is hoped that the discussion promoted in this text will contribute to the academic debate regarding this topic and that it will help the members of the Executive, the Legislative and the Judicial Branches improve their own performance.
