Resumo:This study aims to analize the pratical and legal effects of the criminalization of drugs within the right to health of its users. In light of the failure of the United States prohibitionist system, alternatives measures have been used on a global scale to present new models of confrontation to the drug problem. Therefore, it is used a critical and legal approach about the ineffectiveness of drug criminalization as a way to protect public health, especially the health of drug users, presenting the harmful aspects of this policy as well as suggesting new possibilities. The theme is extremely current considering the extraordinary appeal under number 635659 wich is being processed by the brazilian supreme court and address the discussion surrounding decriminalization of drugs to self-consumption. Hence the debate from the perspective of heath gains relevance due recente changes in the National Drug Policy and in the law under number 11.343, wich was made through the bill under number 37/2013 and awaits presidential sanction.
