Based on a literature review, we sought to present a history of the notions of childhood and adolescence, as well as the law in relation to these subjects, as well as an overview of how the rights of children and adolescents were established in Brazil. It was observed that childhood is a category endowed with historicity, whose readings and forms of interpretation vary according to time. In this sense, the changes in the legal system on the subject in Brazil were considered as part of this process that is historical. The importance of the advances represented by the implementation of the doctrine of integral protection, in opposition to the theory of the irregular situation, was highlighted. It was found that the permanence of discriminatory practices rooted in common sense affects the exercise of citizenship by children and adolescents. Este trabalho busca entender o papel da sociedade civil na defesa dos direitos das crianças e dos adolescentes. Buscou-se, a partir de uma revisão de literatura, apresentar um histórico das noções de infância e adolescência, bem como do direito em relação a esses sujeitos, além de um panorama de como o direito da criança e do adolescente se estabeleceu no Brasil. Observou-se que a infância é uma categoria dotada de historicidade, cujas leituras e formas de interpretação variam de acordo com o tempo. Nesse sentido, considerou-se as transformações no ordenamento jurídico acerca do tema no Brasil como parte desse processo que é histórico. Ressaltou-se a importância dos avanços representados pela implementação da doutrina da proteção integral, em oposição à teoria da situação irregular.
