The understanding taken by the Federal Supreme Court was also analyzed during the judgment of Direct Unconstitutionality Action 6.380 and notably in the points where it questioned the constitutionality of the article 29 of the aforementioned Executive Order, which dealt with the possibility of framing COVID as an occupational disease. For this, literature review methods were used to study doctrinal concepts and historical constructions of Labor Law institutes; jurisprudence analysis, to seek the understanding that the Labor Courts have been applying in some relevant points; and critical analysis, so that a reflection on the application of the institute and how it should be properly applied can be initiated. At the end of this work, it was observed that the application of the law by the Federal Supreme Court in the judgment of the Executive Order in the Direct Unconstitutionality Action 6,380 of the Federal District was considered adequate. O presente trabalho tem como objetivo fazer um breve estudo do instituto do Direito do Trabalho chamado de doença ocupacional, considerando-se institutos paralelos e princípios do Direito do Trabalho relevantes à discussão para que, a partir daí, se proceda a uma análise de como o Estado brasileiro buscou preservar a saúde das empresas e a manutenção de empregos simultaneamente, em meio à crise sanitária e econômica do COVID-19, destacando-se a Medida Provisória 927/2020. Também se analisou o entendimento tomado pelo Supremo Tribunal Federal quando do julgamento da Ação Direta de Inconstitucionalidade 6.380 e notadamente nos pontos em que questionou a constitucionalidade do artigo 29 da referida Medida Provisória, que tratava da possibilidade de enquadramento do COVID como doença ocupacional. Para isso, utilizou-se os métodos de revisão de literatura, para o estudo de conceitos doutrinários e de construções históricas de institutos do Direito do Trabalho; análise de jurisprudência, para buscar o entendimento que o Supremo Tribunal Federal aplicou em alguns pontos relevantes; e análise crítica, para que seja iniciada uma reflexão acerca da aplicação do instituto e de como deveria ser adequadamente aplicado.
