| Resumo: | The main scope of this work is to discuss and analyze the lack of legal instruments in the Brazilian legal system which can guarantee real support for the families of missing children and adolescents, also demonstrating how such insufficiency, added to the lack of integration between the authorities responsible for dealing with disappearances affects the way the Government deals with the problem. For this purpose, specific objectives were explored, namely: highlighting the vulnerable situation of the families of missing children and adolescents; expose how the assistance and procedures currently adopted by the Government occur, identifying existing gaps and possible areas that need changes, as well as the need for legal instruments to solve the problem; discuss the lack of integration between public security agencies and other entities responsible for dealing with disappearances, with the aim of highlighting the importance of joint and coordinated action between these agencies. Therefore, bibliographical and documental research was used as a methodology, using the deductive method of approach, intending to explore the concepts to highlight the inexistence, in the legal system, of effective and adequate protection of the disappeared children’s and adolescents’ rights and their families’. |
