Different historical contexts offer different paths and interpretations to recognize it. It is intended, in this sense, to offer a historical overview of the different views related to tax incentives as opposed to free enterprise when it collides with the national automobile industry, also considering contemporary legal and extrajuridical influences. In this sense, the present investigation presents a case study method. With this methodological strategy, the objective is to understand how or why the State and companies make certain decisions based on these incentives as well as their effects on the market. Os incentivos fiscais, no desenvolvimento histórico disciplinar do direito tributário, como também na história da indústria automobilística, sempre foram uma pedra de toque para diversos acontecimentos, nacionais ou estrangeiros. Os diferentes contextos históricos oferecem distintos caminhos e interpretações para reconhecê-la. Pretende-se, nesse sentido, oferecer panorama histórico sobre as diferentes visões relacionadas aos incentivos fiscais contrapondo-se a livre iniciativa quando acontece a sua colisão no âmbito da indústria automobilística nacional, considerando também influências jurídicas e extrajurídicas contemporâneas. Nesse sentido, a presente investigação apresenta método de estudo de caso.
