This work is part of the legal field of constitutional, criminal and environmental rights, notably with regard to the protection of life, culture and rights over lands traditionally occupied by indigenous peoples. As a general line of research, it seeks to analyze the extent of socio-environmental damage resulting from the usurpation of indigenous peoples' land rights through the practice of illegal economic activities. I will investigate the chapters and the specific objectives of the central points of the jurisprudential debate and of the Brazilian legislation on the indigenous territory, dealing with the relevant aspects to the legal controversy of the demarcation of these indigenous territories. In this line, find out on the map which are the main areas of illegal exploration and the main related crimes committed by mineral extraction in the illegal regions of Nessa. In order to achieve the proposed objectives, an exploratory bibliographic research methodology was adopted, starting from the analysis of legislation and jurisprudence and by consulting the bibliography of the most relevant articles and studies published in the informative media, on websites, through reports from competent government agencies. . The results obtained in the investigation revealed that the socioenvironmental damage caused by illegal labor on traditional peoples and communities extends from sexual exploitation and labor force, to the destruction of forests, as well as the pollution of rivers that directly impact, mainly The use of toxic elements such as mercury is not a means of life and health for the entire indigenous community. In this life, it is clear that the omission and negligence of the Brazilian State are being responsible for the growing ethniccultural extermination of these multicentennial peoples. |

O presente trabalho está inserido no campo jurídico das áreas de direito constitucional, penal e ambiental, notadamente, quanto à proteção à vida, à cultura e do direito às terras tradicionalmente ocupadas pelos povos originários. Como linha de pesquisa geral buscou-se analisar a extensão dos danos socioambientais resultantes do cerceamento do direito à terra dos povos indígenas pela prática da atividade econômica da garimpagem ilegal. Já os capítulos e os objetivos específicos investigaram os pontos centrais de debate jurisprudencial e da legislação brasileira sobre o território indígena, tratando dos aspectos atinentes a relevante controvérsia jurídica da demarcação desses territórios indígenas. Nessa linha, buscou-se mapear quais são as principais zonas de exploração ilegal e os principais crimes correlatos praticados pelo extrativismo mineral ilegal nessas regiões. Com o fim de atingir os objetivos propostos foi adotada a metodologia de pesquisa bibliográfica exploratória a partir da análise da legislação e jurisprudência e através da consulta à bibliografia mais relevante de artigos e estudos publicados no meio informacional, em sites por meio de relatórios dos órgãos governamentais competentes. Os resultados obtidos na investigação revelaram que os danos socioambientais causados pelo garimpo ilegal sobre os povos e comunidades tradicionais se estendem desde a exploração sexual e da força de trabalho, até o desmatamento da floresta, no assoreamento e a contaminação dos rios que impactam diretamente, elementos esses que afetam o modo de vida e saúde de toda comunidade indígena.
