In this sense, the foreseen art can also be limited to the exercise of retromention of a study of the powers of the extravagant legislation that, equally, the existence of the Requisitioning. In the absence of a set of objectives and benchmarks for a criminal investigation, regarding the need for a study of its scope, carried out with caution, and in accordance with the due formalities, with the determination to understand that as all processes are guaranteed, and so that fundamental rights are minimally guaranteed. Therefore, it is intended to demonstrate the indispensability or not of judicial control of investigative procedures, notably through the study of articles 13-A and 13-B of the Criminal Process Code, as a way of ensuring respect for the norms and principles that govern the production of evidence during a criminal investigation. Esta monografia abarca a utilização do Poder Requisitório do Delegado de Polícia como ferramenta essencial para o deslinde das investigações criminais, bem como toda a problemática que o envolve, seja no contexto jurídico e doutrinário. Nesse sentido, partindo de uma análise do art.6ª do Código de Processo Penal, foi possível estabelecer eventuais limites ao exercício da referida prerrogativa, além de um estudo dos artigos da legislação extravagante que, igualmente, atestam a existência do Poder Requisitório. De maneira análoga, a ausência de um conjunto normativo que estabeleça os critérios e balizas de uma investigação criminal, provocou a necessidade de um estudo acerca de seu alcance, de acordo com as devidas formalidades, com objetivo de determinar que as provas obtidas sejam íntegras, e para que os direitos fundamentais do réu sejam integralmente garantidos neste processo.
