Resumo:This paper discusses incarceration in contemporaneity and its crossings of class, race and gender. In a materialistic perspective, it addresses the relationship between law, the conformation of the State and capitalism, pointing out the historical and contradictory character of political structures. It investigates the Brazilian reality, its context of crisis and the advance of neoliberalism, as well as the process of pauperization that is designed and undertaken, the debate about the advancement of the Criminal State in this context, its articulation with racism and the gender issue. The reflections were supported by bibliographic and documentary research, in which data collection was based on the search for the descriptors "incarceration" and "prisoners" on the Scielo platform. The final conclusions indicate that there is an invocation of the penalty in the country, sustained by racism and the criminalization of poverty, which is expressed as an exacerbated imprisonment, as a regulatory mechanism that aims to maintain capitalist social relations.
