Resumo:The exacerbated use of natural resources generates countless environmental impacts, from their extraction to their final disposal, being a problem in which it intensified during the industrial revolution. Today's society, the result of accelerated industrialization, has become hostage to consumerism and the unconscious use of the environment, generating tons of waste every day and disposing of it inappropriately. Addressing and comparing the main legislation related to solid waste, being the Brazilian Law nº 12.305/2010 and the European Directive 2008/98/EC. This work aims to show the main data about the current situation of the Brazilian and European scenario, their differences and why they have such different results, using the methodology of bibliographic research and analysis of the main indicators in a qualitative and quantitative way, thus demonstrating the effectiveness of legislation. And from the data collected, it was pointed out why Brazil has a management considered inferior in relation to the management of European countries, showing the main Brazilian failures, analyzing the execution of national legal instruments, and raising questions mainly in relation to the inefficiency of the Brazilian recycling process and the unlimited use of dumps and landfills.
