description The marginalization that sociocultural, racial and gender minorities suffer in Brazil is a difficult reality reflected in the alarming numbers of violence. In the prison system, the experience of these groups is even more challenging due to prejudice and the lack of guarantee of their rights. Thus, the objective of this article is to analyze the criminal execution of transsexual people in a closed regime, presenting the criteria for separating detainees in prison units, studying what gender identity is and whether there are principles, norms in legislation or existing jurisprudential understandings taking into account the trans portion. Bearing this information, it is intended to infer if such guarantees are being applied to the criminal execution of transsexuals or if there is a violation. Bibliographic and documentary research was adopted as a methodological procedure, supported by jurisprudential understandings, with the purpose of analyzing the difficulties of the current scenario. The discussion of the theme was active, but, due to the affront to the principles of dignity, humanity and the individualization of the penalty and, because it is a fragile portion of the population, it lacks specific protections, thus, reforms are proposed. legislation, especially in the Penal Execution Law, aimed specifically at serving incarcerated transsexuals, offering greater guarantees of their rights. Another proposal is the structural change in the existing prison units, seeking to create private spaces for trans individuals, thus guaranteeing the effectiveness of the execution of the sentence without removing the guarantees and fundamental rights that these individuals must enjoy in practice.

A marginalização que as minorias socioculturais, raciais e de gênero sofrem no Brasil é uma difícil realidade refletida nos alarmantes números da violência. No sistema prisional a vivência destes grupos mostra-se ainda mais desafiadora em razão do preconceito e da falta de garantia dos seus direitos. Assim, o objetivo do presente artigo é analisar a execução penal das pessoas transexuais em regime fechado, apresentando os critérios de separação dos detentos nas unidades prisionais, estudando o que é identidade de gênero e se há princípios, normas na legislação ou entendimentos jurisprudenciais existentes atendendo a parcela trans. Portando tais informações, pretende-se inferir se tais garantias estão sendo aplicadas a execução penal dos transexuais ou se há violação. Adotou-se como procedimento metodológico a pesquisa bibliográfica e documental, com apoio em entendimentos jurisprudenciais, tendo por finalidade analisar as dificuldades do cenário atual. Observou-se ativa a discussão da temática, mas, devido a afronta aos princípios da dignidade, da humanidade e da individualização da pena e, por tratar-se de uma porção fragilizada da população, carece de proteções específicas, assim, propõe-se reformas legislativas, especialmente na Lei de Execução Penal, visando atender especificamente aos transexuais encarcerados, oferecendo maiores garantias dos seus direitos.
