In the present work develops the study of economic organization of the new model of the
contemporary state, the regulatory state as a promoter of enforcement of fundamental rights,
the theme is defined in economic regulation of the oil, natural gas and biofuels in the sense of
accomplishment the fundamental right to an ecologically balanced environment. The history
of the modern West is being built through considerable changes in its model, from the
absolutist state until the current regulatory state, has a history of changes caused by social and
economic changes. It presented to the state: liberal, social welfare, and the current regulatory
framework. In his percussion of mutations have been built a chain of fundamental rights,
based on human needs and desires. Each floor of the building is composed of fundamental
rights and by the particular contexts of each era, and each corresponding state model. About
the construction of these rights, the end of Welfare State and the establishment of the
regulatory state was accompanied by an extreme need for environmental protection. Already
the political had a decrease of the state, an increase of the precepts of free market, an apology
to the principle of free enterprise, however, did not leave the state altogether, took a feature of
regulation of economic activities in order to avoid the disturbances caused by unlimited
application of the principle of free enterprise. The proposed regulation is performed by
regulatory agencies in Brazil, and aims to regulate these sectors of the market, effecting rights
like the one about balanced environment. That is the reason why we need a state
environmental regulator. In this regard, the National Petroleum Agency gained prominence in
the face of high environmental risks of oil activities. In this dissertation, this work develops
the study of economic organization of this new model of state, the state governor, as a
promoter of enforcement of fundamental rights, the issue is bounded on the economic
regulation of the oil, natural gas and biofuels towards realization of the fundamental right to
an ecologically balanced environment. So part of building a concept of regulatory state, and
economic organization of states, especially a gathering of the evolution of this organization in
Brazil, and mounting environmental values in the Brazilian legal system. After that, we work
with the limited scope of regulatory agencies, key bodies of the configuration of a regulatory
state, dealing with mechanisms of control of his actions, besides the very legitimacy of the
agencies, especially as regards the competence of production rules. Finally, we analyze the
construction of economic regulation of the oil, natural gas and biofuels, in Brazil, highlighting
the environmental performance of the National Petroleum Agency. In developing this work
we used the deductive method was applied throughout the work of Le Play monographic
method, besides this, we used the method strongly functionalist and structuralist. It's used
widely in domestic and foreign doctrines, especially of Portuguese, Spanish, French, German
and Italian, the works range from general content on Constitutional Law, Environmental Law,
Oil, to specific topics such as economic regulation, environmental protection in the oil
industry. Also includes the material used documents such as resolutions, laws, ordinances,
since it is an exhaustive study of the possibilities of environmental regulation of the National
Petroleum Agency. Even as documents, was held jurisprudential research in the higher courts,
with the aim of the firm understanding of the institutions under Brazilian jurisdiction over the
issue of economic regulation. |

No presente trabalho desenvolve-se o estudo da organização econômica do novo modelo de Estado contemporâneo, o Estado regulador, como promotor de efetivação dos direitos fundamentais, o tema é delimitado na regulação econômica do setor de petróleo, gás natural e biocombustíveis no sentido de efetivação do direito fundamental ao meio ambiente ecologicamente equilibrado. A história dos Estados modernos ocidentais está sendo construída através de mudanças consideráveis em seu modelo, desde o Estado absolutista até o atual Estado regulador, tem-se uma trajetória de transformações causadas por modificações sociais e econômicas. Assim, apresentou-se o Estado: liberal, de bem estar social, e o atual regulatório. Em seu percurso de mutações foram sendo construída uma cadeia de direitos fundamentais, pautada nas necessidades e anseios humanos. Cada andar da edificação dos direitos fundamentais é composta pelas particularidades e contextos de cada época, e de cada modelo de Estado correspondente. No plano da construção desses direitos, o fim do Estado de bem estar social e o estabelecimento do Estado regulador foi acompanhado por uma necessidade de proteção ambiental extrema. Já no plano político teve-se uma diminuição do Estado, um aumento dos preceitos de livre mercado, uma apologia ao princípio da livre iniciativa, no entanto, o Estado não se ausentou por completo, assumiu uma feição de regulação das atividades econômicas, no intuito de evitar os distúrbios ocasionados pela aplicação ilimitada do princípio da livre iniciativa. A regulação proposta é realizada no Brasil pelas agências reguladoras, e estas tem como finalidade regular setores do mercado, efetivando direitos, como o direito ao meio ambiente equilibrado. Daí a afirmação de um Estado regulador ambiental. Neste aspecto, a Agência Nacional do Petróleo ganha destaque ante os altos riscos ambientais das atividades petrolíferas. Assim, parte da construção de um conceito de Estado regulador, e da organização econômica dos Estados, em especial um apanhando da evolução dessa organização no Brasil, e da montagem dos valores ambientais no ordenamento jurídico brasileiro. Após, trabalha-se com os limites de atuação das agências reguladoras, órgãos essenciais a configuração de um Estado regulador, tratando dos mecanismos de controle de seus atos, além da própria legitimidade das agências, principalmente, tratando-se da competência de produção normativa. Por fim, analisa-se a construção da regulação econômica do setor de petróleo, gás natural e biocombustíveis, no Brasil, destacando a atuação ambiental da Agência Nacional do Petróleo. No desenvolvimento do trabalho utilizou-se do método dedutivo, aplicou-se durante todo o trabalho o método monográfico de Le Play, além deste, usou-se fortemente o método funcionalista e estruturalista. Usou-se largamente de doutrinas nacionais e estrangeiras, principalmente, de origem portuguesa, espanhola, francesa, alemã e italiana, as obras abrangiam desde conteúdos gerais sobre Direito Constitucional, Direito Ambiental, Direito do Petróleo, até temas específicos como regulação econômica, proteção ambiental na indústria do petróleo. Integra também o material utilizado documentos como Resoluções, Leis, Portarias, visto que se trata de um estudo exaustivo das possibilidades de regulação ambiental da Agência Nacional do Petróleo.
