The countless divergences and stigmas that surround the theme are not forgotten, and some even treat such relationships as the “legalization of infidelity”. However, closing eyes to this patent reality only ends up encouraging this type of behavior. Thus, the judiciary cannot be exempt from social facts, since the Law is an instrument for resolving conflicts established in society. What is being discussed, then, is whether relegating these families to a place of non-law would not violate basic principles of the Constitution. It has as justification the legal and social relevance that surrounds the present theme. Finally, we turn to the judgments of Brazilian courts, intending to investigate about the legal treatment that has been destined to the causes that involve parallel families and that, nowadays, are presented to the Judiciary, paying attention to the arguments predominantly used in the decisions. Trata o presente trabalho de uma análise, a luz dos valores constitucionais, acerca da possibilidade de conferir às relações paralelas status de família, entendendo-se a família como espaço de realização pessoal dos indivíduos e como verdadeiro locus de manifestação da personalidade desses. Não se olvida das inúmeras divergências e estigmas que circundam o tema, chegando, inclusive, alguns a tratar tais relações como a “legalização da infidelidade”. Contudo, fechar os olhos para essa realidade patente termina apenas por incentivar esse tipo de comportamento. Assim, o judiciário não pode ser eximir dos fatos sociais, vez que o Direito constitui instrumento de resolução dos conflitos instaurados na sociedade. O que se discute, então, é se relegar essas famílias a um local de não direito, não estaria por violar princípios basilares da Constituição. Tem-se como justificativa a relevância jurídica e social que circunda o presente tema.
