| Resumo: | This study deals with the civil liability of dental surgeons for damages
caused by their professional activity. In observance of the expansion of that
professional's performance, especially in aesthetic procedures, and in view of the
increase in legal proceedings against these professionals, the objective is to delimit
the criteria that should be used to define the dentist's civil liability for aesthetic or
pathological damage arising from their activity, delimiting and exposing the guiding
criteria of their responsibility. The methodological procedures consist of basic,
descriptive, bibliographical, documentary, qualitative research, with a hypotheticaldeductive approach and a monographic procedure. It is concluded that civil liability
arising from dental activity is subjective, with peculiarities due to the procedure, the
consequence and the burden of proof. |
