Resumo:Violence data in Brazil, specially regarding crimes against life, shows an unsatisfactory evolution. To find effective solutions and alternatives to the current incarceration policy, an analysis of the zetetic/dogmatic relation between crime and violence can be positive, in order to delve into the criminal dogma and not only the application of the law, examining the causes of the criminal behavior to investigate ways to neutralize It. Hence, in the 70s and, in Brazil, in the late 90s, emerged the Restorative Justice, a methodology oriented towards the resolution of criminal conflicts that relies on Restorative practices that entails the protagonism, in the judicial process, of the subjects involved – the victim, the offender and the community, through Meetings and open dialogues, in a way that everyone feels contemplated and with real expectations of repair, and that makes It different from the traditional model of retributive Justice, that is focused on the punishment of the offender with no regards for the feelings and needs of the victim and the community. Restorative Justice looks into the Future hen It Focus on the needs of the subjects involved, as well in the restoration of the severed relationships by the acts of the offender, providing gains to all, including the community. In this research we identify the acknowledgement of the adequacy of the Restorative Justice in the treatment of criminal conflicts in the socio-environmental sphere, as long as the issues are analyzed through the lenses of the systemic thinking (instead of the traditional science thinking), that takes into consideration the following elements: complexity, instability and intersubjectivity.
