description The present work aims to analyze how the process of formation and expansion of “Sindicato do Crime” is a reflection of the omissions represented by the problems of the prison system in Rio Grande do Norte. In this sense, through bibliographical research with a qualitative and sociological approach, we sought to understand the dynamics of criminal factions, especially the “Sindicato do Crime”, in the context of degradation of the prison environment, recognized by the Supreme Court as an Unconstitutional State of Things. Therefore, the work found that there is a crisis in the penitentiary system of Rio Grande do Norte, which is a reflection of the State's inability to protect its prisoners, creating a strategic environment for the formation and expansion of criminal groups, such as the PCC and, later, the SDC, which currently holds the monopoly of prisons in Rio Grande do Norte. As a result of this process, the criminal scene in RN was modified, with the State observing the growth of its rates of violence, according to the analysis of homicide rates, reaching its peak in 2017, when the war between the factions broke out. Finally, it should be noted that, despite the drop in homicide rates in the last two years, a population in the state is still dealing with the consequences of the dynamics of organized crime in the state.

O presente trabalho tem como escopo analisar como o processo de formação e expansão do Sindicato do Crime é reflexo de omissões estatais diante dos problemas do sistema carcerário do Rio Grande do Norte. Nesse sentido, através de pesquisa bibliográfica de abordagem qualitativa e sociológica, buscou-se compreender a dinâmica das facções criminosas, em especial do Sindicato do Crime, no contexto de degradação do ambiente prisional, reconhecido pelo STF como um Estado de Coisas Inconstitucional. Diante disso, o trabalho constatou que há uma crise no sistema penitenciário potiguar, a qual é reflexo da incapacidade do Estado em tutelar seus presos, criando ambiente estratégico para a formação e expansão de coletivos criminosos, tais quais o Primeiro Comando da Capital (PCC) e, posteriormente, o Sindicato do Crime (SDC), que, atualmente, detém o monopólio das prisões do Rio Grande do Norte. Como consequência desse processo, a cena criminal do RN foi modificada, tendo o Estado observado o crescimento de seus índices de violência, conforme análise das taxas de homicídio, atingindo o ápice no ano de 2017, quando eclodiu a guerra entre as facções mencionadas.
