Resumo:This study analyzes the constitutionality of the article 144-A of the Brazilian Federal Law number 6.880/1980 – The Military Statute – and investigates the applicability of its content in recent military public selections for each of the Brazilian Armed Forces. The topics 2 to 4 of this study used the deductive method as well as theoretical, exploratory and quantitative research, through the study of essays, documents, legal devices and general bibliography related to the topic. In topic 5, it was used empirical and quantitative research regarding the data related to the central topic of the study. At first, this study explores what constitutional-legal regime supports the Brazilian armed forces. After that, it goes over the legal operationalization and the formal procedure, through the enactment of the law number 13.954/2019, which included the article 144-A in the Military Statute. It also looks at the object and the extension of the effects of the mentioned article, relating these characteristics to the constitutional principles of equality/isonomy, inviolability of the private life and the attribute of family planning. Furthermore, this study explores the reproduction of the article in public selections notices in 2020 for the Army, Air Force and Navy, providing absolute numbers and percentages. By the end, it clarifies the problems surrounding this topic, proposing possible legal solutions.
