Although they have an specific internacional law, that comes to their status as refugees, many of their groups, going to Europe, dreaming about reconstruction the hope in their lifes, undergoes situations of violation of their rights and guarantees, conferred on not just by their refugee' status, but also inherent on the condition of being human, by some member nations of the Council of Europe which are signatories to the European Convention on Human Rights, which in turn seeks to ensure full protection of human rights. Thus, becomes necessary the detailed explanation and supporting of such breaches in light of the European Regional System for the Protection of Human Rights, established by that Convention, and to carry out the remedial measures undertaken, as well as prove the actual effectiveness of European Regional System. A Comunidade Internacional assiste diariamente à penúria e ao descaso aos quais os refugiados sírios são submetidos em sua árdua luta para sair daquele país arrasado por uma Guerra Civil que já se encaminha para o quinto ano consecutivo. Apesar de terem uma legislação internacional especifica que trata de sua condição de refugiados, grande parte dos grupos que rumam para Europa, emaranhados pela esperança de reconstrução de sua vida, passa por momentos de violação plena de seus direitos e garantias que lhe são conferidos não só por sua condição de refugiado, mas também inerentes à condição de ser humano, por parte de algumas das nações integrantes do Conselho da Europa, as quais são signatárias da Convenção Europeia de Direitos Humanos, que por sua vez visa garantir proteção integral aos direitos humanos.
