Resumo:The Administrative Misconduct Law (Law 8.429/92) was an advance for the control of public administration, but the STF argues that the law list of the authorities of Responsibilities Crimes (Law 1.079/50) because they are governed by special responsibility standards they do not respond to administrative impropriety. And it is through the analysis of legislation, jurisprudence and doctrine, that the theme administrative impropriety will be specified in its main points, in order to bring the reflection on the possibility of application of Law 8.429/92 to the politicians, either concurrent or residually Law 1.079/50, thesis defended respectively by Rogerio Alves Pacheco and Maria Sylvia Pietro among others. In conclusion, whatever the current, the population calls for punishment of ímprobas conduct and seeks an equal treatment to all.
