The present study deals with the analysis of legal demands involving the rights of children with autism from lawsuits arising from the free legal assistance provided by the Center for Legal Practice at the Centro de Ensino Superior do Seridó - CERES, campus of the Federal University of Rio Grande do North - UFRN, located in the city of Caicó, Seridó region. The judicial demands analyzed mostly involve the right to health, portraying the difficulty that autistic children face when trying to access this fundamental right, constitutionally guaranteed. Thus, this research aims to demonstrate, through jurisprudential analysis, how it is possible to identify the position of the Judiciary Power in relation to the issues brought, thus enabling a comparison of those judged in the Serido region based on national legal forecasts. Therefore, the methodology used to support the study consists of deductive research, through bibliographic and documentary material, with a qualitative approach and descriptive objective. Therefore, it is evident that certain rights are not yet easily realized, although there are legal guarantees for people diagnosed with Autism. In this way, the judicial demands that end up overloading the Judiciary are necessary, also causing discomfort and anguish to the families of children with autism who need to deal with so many other issues on a daily basis. O presente trabalho trata da análise de demandas judiciais envolvendo os direitos de crianças com autismo a partir de processos judiciais oriundos da assistência judiciária gratuita prestada pelo Núcleo de Prática Jurídica do Centro de Ensino Superior do Seridó – CERES, campus da Universidade Federal do Rio Grande do Norte – UFRN, localizado na cidade de Caicó, região do Seridó. As demandas judiciais analisadas majoritariamente envolvem o direito à saúde, retratando a dificuldade que crianças autistas enfrentam ao tentarem acesso a esse direito fundamental, garantido constitucionalmente. Assim, esta pesquisa objetiva demonstrar, através da análise jurisprudencial, como é possível identificar o posicionamento do Poder Judiciário frente às questões ajuizadas, possibilitando, com isso, um comparativo dos julgados na região do Seridó a partir de previsões legais pátrias. Para tanto, a metodologia utilizada para embasar o estudo consiste em pesquisa dedutiva, através de material bibliográfico e documental, com abordagem qualitativa e objetivo descritivo. Portanto, evidencia-se que determinados direitos ainda não se efetivam facilmente, embora existam garantias legais às pessoas diagnosticadas com Autismo.
