Resumo: | The purpose of this study is to investigate the economic vulnerability criterion used as a
requirement of hypersufficiency for the provision of the free legal assistance service by the
Public Defender. Regarding the general objective, this one consists in analyzing the criterion
of economic vulnerability established by the Public Defender's Offices, and if this can be
made flexible so that the citizen can be included in the right of attendance of the free services
provided by the Public Defender's Office. Regarding the methodology, this is characterized as
a bibliographical research that uses a qualitative approach. In order to do so, some articles,
monographs, dissertations, theses, judgments, laws, among others, were discussed and
discussed in more detail on the subject matter discussed here. In this context, it is justified to
carry out this research for a better understanding and deepening of the knowledge about the
thematic that involves this work, that is, the importance of the flexibility of the criterion of
hyposufficiency for purposes of the provision of legal service by the Public Defender's Office.
Therefore, it is believed that this work is of great relevance for the juridical scope and for the
whole society that needs free legal assistance for not having to bear the legal costs, since these people in need have the guaranteed right of access to Justice for free, which is a topic that is
much discussed in the literature and which increasingly requires studies that emphasize the
importance for the process of realizing rights. |
