Resumo:Flexibilization of labor rules is directly influenced by economics. So, the financial reestablishment of the companies overlaps the valorization of protective policies, putting at risk the rights conquered by the workers. There is a search for a less protective state in which the well-being of employees takes second place. It’s in this context that the present work is inserted. The theme is explored by taking modern international guidelines for decent work as a parameter, as well as by considering the labor rights already won, even as considering the importance of tripartite dialogue between the actors of labor relation and the State. Flexibilizing labor standards is undeniably necessary against an unstable and in crisis economic situation, however, such relativizations must occur taking as a basis the current parameters of development of well-being, valorization of the worker and protection of his dignity. In this way, both company and employee are benefited. However, this logic is different from the understanding of the Brazilian Government, widely spread in the national media, whose essence consists in the increase of weekly overtime and prefers collective agreements tham the actual legislation.
