| Resumo: | The research presented here aims to demonstrate the evolution of the succession right of the spouse and their parter throghout the Brazilian civil law on the focus of the 1988 Federal Constitution, demonstrating how the spouse's right positively affected the companion's in a succession aspect. Also, the succession right will be addressed from the regressions presented by the Civil Code of 2002, when the laws 8,971 of 1994 and 9,278 of 1996 were revoked, until the recent voting of the Extraordinary Appeal lodged to the Supreme Court regarding to the unconstitutionality of the art. 1,790 of the 2002 Civil Code. |
