description	This paper aims to understand the real situation of the elderly in Brazilian society, analyzing whether Fundamental Rights have been safeguarded as a way of guaranteeing the Dignity of the Human Person. In this sense, it will bring a reflection on the role and importance of the Elderly Statute, Law 10.741 / 2003, as a tool to fight for the rights of the elderly, since it emerges as a specific law to protect the population that reached the third. ensuring the right to life, health, food and housing, access to culture, leisure, transportation, work, sport, citizenship, freedom, the right to be treated with dignity, respect, to live in family and in community. This research will also address the roles of family, society and the state as jointly and severally responsible for defending the rights and guarantees of the elderly. In this perspective, it will address the bias that interweaves Family Law with the Elderly Law, from the perspective of family bonds as guiding threads in the actions of support, assistance and, mainly, as an incentive instrument for the development of new skills even after old age, in order to to grant autonomy and freedom to the elderly in daily tasks. For this, a hypothetical-deductive and qualitative research was conducted, based on applied bibliographic research, as a means of deepening the descriptive objective studies, aiming to obtain a formative evaluation. By conceiving this study, it was possible to better understand the conceptions that permeate the family and social environment in relation to the rights attributed to the Elderly. Thus, it was concluded that there are several relevant attitudes that can be taken to ensure quality of life for the population that has reached old age, but in contrast, there are several challenges to be overcome and that still limit the real sense of the Dignity of the protected human person. Federal Constitution, and the application of the Rights established by the Elderly Statute and the National Elderly Policy.

O presente trabalho tem como objetivo perceber a real situação dos idosos na sociedade brasileira, analisando se os Direitos Fundamentais tem sido resguardados como forma de garantir a Dignidade da Pessoa Humana. Nesse sentido, trará uma reflexão sobre o papel e a importância do Estatuto do Idoso, Lei 10.741/2003, como ferramenta na luta em prol dos direitos dos idosos, uma vez que, surge como uma lei específica de proteção à população que atingiu a terceira idade, visando assegurar em situação de prioridade, o direito à vida, à saúde, à alimentação, moradia, o acesso à cultura, lazer, transporte, trabalho, esporte, cidadania, liberdade, direito a ser tratado com dignidade, respeito, a conviver em família e em comunidade. A presente pesquisa abordará ainda, os papéis da família, sociedade e do Estado como responsáveis, solidariamente, pela defesa dos direitos e garantias do idoso. Nessa perspectiva, abordará o viés que entrelaça o Direito de família ao Direito do Idoso, sob a ótica dos vínculos familiares como fios condutores nas ações de amparo, assistência e principalmente, como instrumento incentivador do desenvolvimento das habilidades mesmo após a velhice, a fim de conceder autonomia e liberdade ao idoso nas tarefas do cotidiano. Para tanto, foi realizada uma pesquisa com abordagem hipotético-dedutiva e qualitativa que se baseou em pesquisa aplicada de bibliografias, como meio de aprofundar os estudos de objetivo descritivo, visando obter uma avaliação formativa. Ao conceber este estudo, foi possível compreender melhor as concepções que permeiam o ambiente familiar e social em relação aos direitos atribuídos aos Idosos.
